The Coordinative Body for Intellectual Property, within its competencies for establishing coordination in the enforcement of the protection of industrial property rights, in the middle of June 2019 conducted coordinated activities in three legal entities that have violated the industrial property rights. The activities were carried out upon prior request for action, submitted by the right holders. For the efficient implementation of the measures and activities, representatives of the State Market Inspectorate, the Public Revenue Office and the Ministry of Interior participated in the surveillance.
During the inspections carried out at the indicated entities in the Applications for violation of industrial property rights, it was found that the claims in the requests were reasonable.
In these actions, a total of 74 products were seized, which infringe industrial property rights (74 construction products) and 5100 products, which also infringe industrial property rights (5100 fruit drinks).
In these actions, decisions were made by which the legal entities were ordered to withdraw the products and documents related to the product.
Settlement procedures were conducted, in which the perpetrators were fined in the amount of 6000 euros in denarsfor the legal entity and 1,800 euros in denars for the responsible person in the legal entity. Since the settlement procedures were unsuccessful, requests for initiation of misdemeanor procedures were submitted to the competent court.
